TERMS OF SERVICE

Last updated: 10 October 2026

These Terms & Conditions apply to the concierge, travel-planning and booking-assistance services provided by H Belz, a sole proprietor trading as My Cape Town Concierge ("we", "us" or "our").

Business address: Cape Town, South Africa
Email: hello@mycapetownconcierge.com
WhatsApp / Telephone: +27 71 69 050 4802
Tourist Guide Registration: WC16513

By purchasing or using one of our paid services, you agree to these Terms & Conditions.

1. What we do

My Cape Town Concierge provides independent concierge, local information, recommendation, travel-planning, reservation and booking-assistance services for visitors to Cape Town and the Cape Winelands.

Depending on the service purchased, we may:

  • provide recommendations and local information;
  • suggest restaurants, attractions, activities and experiences;
  • assist with restaurant and other reservations;
  • identify suitable third-party service providers;
  • check availability with third-party providers;
  • assist you in arranging tours, transfers, activities and other services;
  • provide itinerary and trip-planning assistance; and
  • provide general practical information about Cape Town and the Winelands.

Our normal service hours are 07:00–22:00 South African time (SAST), seven days a week. We aim to respond to WhatsApp messages within 60 minutes during these hours, but response times cannot be guaranteed.

2. Our concierge packages

Our current services and prices are displayed on our website and may change from time to time.

At launch these may include:

Ask a Local — Free
One general local question and response.

Cape Day Pass — R299
Concierge assistance for 24 hours from activation.

Cape Stay Pass — R795
Concierge assistance for up to seven consecutive days.

Cape Trip Plan — R1,495
A personalised Cape Town and/or Winelands trip plan, reasonable booking assistance and a seven-day Stay Pass.

All prices are stated in South African Rand (ZAR), unless expressly stated otherwise.

Reasonable-use limits apply. Paid concierge access does not constitute unlimited travel research, unlimited itinerary preparation or an obligation to remain continuously available to an individual customer. If a request falls materially outside the service purchased, we will tell you before undertaking additional chargeable work.

3. Third-party services

We are an independent concierge and intermediary. We are not the provider or operator of third-party services that we recommend or help you arrange.

These may include, for example:

  • tours and experiences;
  • transport and transfers;
  • restaurants;
  • accommodation;
  • wine estates;
  • boat trips;
  • adventure activities;
  • guides;
  • private chefs;
  • childcare services;
  • wellness providers;
  • equipment rental; and
  • other tourism or hospitality services.

Unless expressly stated otherwise, your contract for a third-party service is directly between you and the relevant third-party provider.

The third-party provider is responsible for delivering its service and for its own licences, registrations, insurance, staff, vehicles, equipment, health and safety requirements and legal obligations. Third-party services are also subject to that provider's own terms, cancellation policies and conditions.

4. Third-party payments

Unless we expressly agree otherwise in writing, you will pay third-party providers directly.

We do not normally collect or hold money on behalf of third-party providers.

Before confirming a third-party booking, you should satisfy yourself regarding the provider's:

  • final price;
  • inclusions and exclusions;
  • payment terms;
  • cancellation policy; and
  • any special conditions applying to the booking.

5. Commissions and commercial relationships

We may receive a referral fee, commission, preferential rate or other commercial benefit from certain third-party providers when a customer books through us or as a result of our recommendation.

We will not charge you an undisclosed additional fee simply because we receive a supplier commission.

Where required, or upon reasonable request, we will provide information about commissions or other consideration relevant to a recommendation or transaction.

We aim to make recommendations based primarily on suitability for the customer's requirements rather than the commission available to us.

Where a commercial relationship could reasonably create a material conflict of interest, we will disclose it.

6. Recommendations

Our recommendations are based on our local knowledge, professional judgement, customer requirements and information reasonably available to us at the time.

Travel, hospitality and tourism experiences are subjective. A recommendation that suits one customer may not suit another.

Information including prices, operating hours, availability, menus, weather conditions, access arrangements and schedules can change without notice.

We therefore cannot guarantee that information supplied by a third party will remain accurate after we provide it.

7. Availability and bookings

All third-party bookings are subject to availability.

We cannot guarantee:

  • restaurant tables;
  • activity or tour availability;
  • weather conditions;
  • access to attractions;
  • transport availability;
  • specific guides, vehicles or personnel; or
  • acceptance of a booking by a third-party provider.

A request made to us does not constitute a confirmed third-party booking.

A booking is only confirmed when the relevant provider has confirmed it in accordance with its normal booking process.

8. Customer responsibilities

You are responsible for providing accurate information relevant to your request, including where applicable:

dates and times;

  • number and ages of travellers;
  • dietary requirements;
  • mobility requirements;
  • allergies or medical considerations relevant to an activity;
  • budget;
  • collection location; and
  • any other information reasonably required to make a suitable recommendation.

You remain responsible for deciding whether a recommended service or activity is appropriate for you and your travelling party.

9. Safety and emergencies

Our WhatsApp concierge is not an emergency service.

In an emergency, contact the appropriate emergency services or relevant authorities directly.

We do not provide medical, legal, financial or emergency-response advice.

For outdoor, adventure or other higher-risk activities, customers should follow the safety instructions and requirements of the relevant service provider.

10. Cancellation and refunds — our services

Cancellations, date changes and refunds relating to our concierge packages are governed by our separate Cancellation & Refund Policy, available on our website.

This policy explains the applicable cancellation notice periods, when services commence, refund eligibility and how to request a cancellation or refund.

Nothing in these Terms & Conditions or our Cancellation & Refund Policy limits any rights or remedies available to customers under applicable South African consumer-protection legislation.

Nothing in these Terms is intended to remove or restrict any consumer right that cannot lawfully be excluded.

11. Third-party cancellations and refunds

Third-party bookings are governed by the cancellation and refund policy of the relevant third-party provider.

Because you normally pay the provider directly, any refund relating to that provider's service must ordinarily be requested from that provider.

We will provide reasonable assistance with communications where appropriate but cannot guarantee that a provider will approve a refund.

12. Limitation of our role and liability

We will provide our concierge services with reasonable care and skill.

However, to the fullest extent permitted by South African law, we are not responsible for the acts, omissions, negligence, delays, cancellations or service failures of independent third-party providers.

We are also not responsible for circumstances outside our reasonable control, including severe weather, road closures, load-shedding, strikes, natural events, government restrictions, attraction closures or other similar events.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including rights or remedies available to consumers under applicable South African consumer legislation.

13. WhatsApp and electronic communications

Our service is primarily provided through WhatsApp and other electronic communications.

You are responsible for maintaining appropriate internet/mobile access and for any data or roaming costs charged by your telecommunications provider.

WhatsApp and other third-party technology platforms operate independently from us and may occasionally experience outages or technical problems.

14. Personal information

We process personal information in accordance with our Privacy Policy and applicable South African privacy legislation.

We may need to provide relevant information to a third-party provider where this is necessary to make a reservation or arrange a requested service.

We will not add you to ongoing electronic marketing solely because you used our concierge service.

15. Complaints

If you are unhappy with our concierge service, please contact:

Email: hello@mycape townconcierge.com
WhatsApp: +27 69 050 4802

We will attempt to resolve reasonable complaints promptly and fairly.

Complaints relating specifically to a third-party service should ordinarily also be directed to the provider responsible for delivering that service.

16. Changes to these terms

We may update these Terms & Conditions from time to time.

The version applicable to a paid concierge service will ordinarily be the version available when that service was purchased, unless a change is required by law or is beneficial to the customer.

17. Governing law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Nothing in these Terms prevents a consumer from exercising rights or remedies available under applicable South African consumer-protection legislation.
